Murder Rate in Canada [Statistical Analysis]

A homicide that takes place with an intent to kill and with prior preparation and plan is first-degree murder. Line 231 (2) of the Criminal Code states that it is a “planned and deliberate” act of eliminating a human life.

However, according to 231 (4), regardless of the motivation of a homicide [deliberate nor unintentional], the following cases will be considered an act of 1st-degree murder:

  1. Killing a cop or any other peace officer
  2. Neutralizing a prison worker, both permanent and temporary
  3. Killing for terrorist activity
  4. Murdering someone benefits organized crime groups

Second Degree Murder

Second-degree murder is attacking someone with the intent to kill but without any pre-plan.

Each second-degree murder is very similar to first-degree murder. The only difference is the absence of a deliberate attempt.

What is Manslaughter?

Manslaughter is also third-degree murder. It happens when a person kills another person in the act of defending himself or accidentally. Manslaughter is unplanned and unintentional homicide. There are two types of manslaughters: a). voluntary manslaughter, and b). involuntary manslaughter.

Voluntary Manslaughter

In this case, the accused is charged with hitting or attacking the victim with no intent to kill but hurt. However, the result of the action caused the victim’s life. The use of firearms or other lethal weapons is considered an act of voluntary manslaughter, and the punishment is extreme.

Involuntary Manslaughter

In this scenario, the accused did not want to hurt the victim, but his/her action unexpectedly caused the victim’s life. Involuntary manslaughter will face the least severe punishment.
